Attorney Anthony John Jurek practices defense against criminal prosecution and appeal of criminal convictions. He defends against and prosecutes petitions for restraining orders and injunctions, appeals denials, and revocations of Concealed Carry Permits, and he has sought federal habeas relief for clients convicted in State courts. He is admitted to practice in all Wisconsin courts, the Wisconsin Supreme Court, and the federal Western District of Wisconsin.

Anthony graduated from University of Wisconsin Law School where he focused on constitutional and criminal law. While he was a student, he was a project assistant for his criminal law professor and a paid consultant for a forensic psychologist. He interned with both the Wisconsin Coalition Against Domestic Violence and the Wisconsin Supreme Court.

After law school, Anthony was appointed Special Prosecutor in a rural Wisconsin county performing the functions of an Assistant District Attorney and additionally writing the county’s grant for a diversion program. Anthony has served as adjunct faculty teaching legal research for the paralegal program and as a guest lecturer on ethics at Madison College.

Anthony is currently an at-large board member of the Wisconsin Association of Criminal Defense Lawyers (WACDL). As a member of WACDL’s Legislative Affairs Committee, he regularly speaks to the Wisconsin legislature and Wisconsin Supreme Court regarding pending legislation and proposed statutory or rule changes. He has previously served as Secretary of the Dane County Criminal Defense Lawyers Association and Chair of the Dane County Bar Association’s Criminal Law section. He has volunteered as an attorney representing students in the Madison Student Expulsion Prevention Program and regularly appears on both local and national media as a commentator and legal analyst.

Anthony has argued – and won – before the Wisconsin Supreme Court, where he succeeded in getting Wisconsin’s unconscious blood draw statute declared unconstitutional. He has pressed appeals in the Wisconsin Court of Appeals where he successfully obtained the rare grant of interlocutory relief while a criminal case was pending. He has also successfully petitioned the Governor of Wisconsin for pardons.

In his free time Anthony hikes, rock climbs, and engages in “run and gun” pistol/rifle/shotgun competitions. Rather predictably, he rides a Harley.

Practice Experience

• Successfully argued to the Court of Appeals and the Wisconsin Supreme Court that Wisconsin’s unconscious blood draw statute was unconstitutional.

• Successfully argued a case to the Wisconsin Supreme Court regarding defendant competency postconviction, with implications on criminal defense competency matters generally and counsel’s ethical duties particularly.

• Sought and obtained a rare grant of relief in the context of an interlocutory appeal while a criminal case was pending.

• Successfully wrote and argued a postconviction motion resulting in a jury trial verdict of “guilty” being vacated and the case dismissed with prejudice where the prosecution had failed to preserve exculpatory evidence in a sexual assault case.

• Successfully wrote and argued a suppression motion resulting in the dismissal of a felony OWI where the police had exceeded the scope of their search in violation of the 4th Amendment.

• Obtained “not guilty” jury verdicts in a variety of trials on various charges including felony strangulation, OWI, bail jumping, and many others.

• Successfully mitigated consequences for convicted defendants at sentencing.
